How can reserved employees arrange a vacation abroad? Explanation from the Ministry of Justice.


During the state of martial law, leaving the country for men aged 18 to 60 is restricted. Exceptions include certain categories of individuals, among which are reserved employees. This was reported by 'Glavkom', citing the Ministry of Justice.
Who can cross the state border?
The rules for crossing the state border by Ukrainian citizens state that military conscripts who are not subject to conscription during mobilization have the right to cross the state border.
According to paragraph 1 of part one of Article 23 of the Law of Ukraine 'On Mobilization Preparation and Mobilization', military conscripts who are reserved for the period of mobilization and in wartime are not subject to conscription. Such individuals are on special military accounting. Despite this, the rules specify only the procedure for crossing the state border by a reserved employee on a business trip. Regarding the possibility of crossing the border during vacation - there is no clear regulatory legal regulation.
What documents are needed?
- Ukrainian citizen passport for traveling abroad;
- Paper military accounting document or an electronic version in the 'Reserv+' application (must contain a mark on reservation and entered into the 'Oberih' system);
- Extract from the order about vacation or its copy (must contain information about the destination country, duration of stay, position of the employee, etc.);
- Other documents to confirm the purpose of the trip.
The Ministry of Justice emphasizes: an employee planning to go on vacation abroad must not have restrictions that would impede leaving the country or violate military accounting rules.
It should be noted that some military conscripts, reserved by employers from mobilization, may leave the country in certain cases. This was stated by the spokesman for the State Border Guard Service Andriy Demchenko.
